1987, which (1) affirmed an order of that Supreme Court (Morrie Slifkin, J.), granting plaintiff's motion for summary judgment
declaring unconstitutional Judiciary Law 39 insofar as it promulgated salary differentials between a Judge of the City Court
of Mount Vernon and Judges of the City Courts of Yonkers and White Plains, and (2) remitted the matter to Supreme Court for
further proceedings.
